ARTICLE 1.2 – BUYER
The person who registers as a customer on the fouramour.com shopping site. The address and contact details given at registration are taken as the basis. The identity details stated by the Customer are deemed to be correct. Any legal or criminal liability arising from incorrect or untrue information entered belongs to the Customer.
ARTICLE 2 CHARACTERISTICS OF THE PRODUCT SOLD
The essential characteristics of the goods or services are published at www.fouramour.com. You may review the essential characteristics of the product throughout the sale and/or campaign period. Should the Seller or the manufacturer offer new products with similar or identical characteristics, the essential characteristics of the products may change.
The prices listed and announced on the site are the sale prices. Announced prices and commitments are valid until they are updated or changed. Prices announced for a limited period are valid until the end of the stated period. The Seller reserves the right to change sale prices during the period of the listing.
The type, quantity, brand/model, colour, number of units, sale price and payment method of the goods/product/service consist of the information as it stands at the moment the order is completed.
The shipping/postage cost of dispatching the product is paid by the BUYER and is not refunded. Free shipping is provided on orders of 2,000 TL and over. The Seller may raise this threshold.
ARTICLE 3 GENERAL PROVISIONS
3.1) The BUYER declares that they have read and understood the preliminary information on the fouramour.com website regarding the essential qualities of the product, its sale price, the payment method and delivery, and that they have given the necessary confirmation electronically. By confirming this Pre-Contractual Information electronically, the BUYER also confirms having correctly and completely received the address, the essential characteristics of the products ordered, the prices of the products including taxes, and the payment and delivery information that the SELLER must provide, and accepts the terms set out in the information.
3.2) The product subject to the contract is delivered to the BUYER or to the person/organisation at the address indicated within the period explained in the preliminary information on the website, depending on the distance of the BUYER's location, and in any case not exceeding the statutory 30 days, for each product.
3.3) The SELLER cannot be held responsible if the ordered product cannot be delivered to the BUYER because of any problem the courier company encounters during delivery. In that case the BUYER's counterparty is the courier/postal company.
3.4) The SELLER is responsible for delivering the product subject to the contract intact, complete, in line with the qualities specified in the order and, where applicable, together with warranty documents and user manuals.
3.5) The SELLER may supply a different product of equal quality and price by informing the BUYER and obtaining their express approval before the period of performance expires.
3.6) If the SELLER cannot fulfil the contractual obligations because performance of the product or service ordered has become impossible, the SELLER notifies the consumer before the period of performance expires and refunds the total amount to the BUYER within 10 days.
3.7) Electronic confirmation of this information and of the contract is required for delivery of the product. This confirmation means the contract has been signed. If for any reason the price of the product is not paid or is cancelled in the bank records, the SELLER is deemed released from the obligation to deliver the product.
3.8) If, after delivery, the BUYER's credit card is used unfairly or unlawfully by unauthorised persons through no fault of the BUYER, and the bank or financial institution concerned therefore does not pay the price to the SELLER, the BUYER must return the product to the SELLER within 3 days, provided it has been delivered to them. In that case the shipping costs belong to the BUYER.
3.9) If the SELLER cannot deliver the product within the period because of force majeure or extraordinary circumstances preventing transport, such as adverse weather or interruption of transport, the SELLER is obliged to notify the BUYER. In that case the BUYER may choose to cancel the order, to have the product replaced with an equivalent if available, and/or to have the delivery period postponed until the obstacle is removed. If the BUYER cancels the order, the amount paid is refunded in cash and in full within 10 days. For payments made by credit card, the amount is returned to the relevant bank within 7 days of the BUYER cancelling the order. As the appearance of that amount in the BUYER's account thereafter depends entirely on the bank's own processing, the BUYER accepts in advance that the SELLER cannot intervene in any possible delay, and that it may take an average of 2 to 3 weeks for an amount refunded to a credit card to be reflected in the BUYER's account by the bank.
ARTICLE 4 RIGHT OF WITHDRAWAL
4.1. In distance contracts for the sale of goods, the BUYER may exercise the right of withdrawal by rejecting the goods within 14 (fourteen) days of delivery to themselves or to the person/organisation at the address indicated, without assuming any legal or criminal liability and without giving any reason. In distance contracts for the provision of services, this period begins on the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where, with the consumer's consent, performance has begun before the withdrawal period ends.
4.2. To exercise the right of withdrawal, written notice must be given to the SELLER within the 14-day period by registered mail with return receipt, notarial notice or the e-mail address published on the website, and the product must be unused within the meaning of Article 5. Where this right is exercised:
a) the invoice of the product delivered to the BUYER or to a third party is required. (If the invoice of the product to be returned is a corporate invoice, it must be sent back together with the return invoice issued by that company. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is issued.)
b) the return form must be completed and sent.
c) products to be returned must be delivered complete and undamaged, with their box, packaging and any standard accessories.
d) the SELLER is obliged to refund the total amount and any documents placing the buyer under obligation within 10 days at the latest of receiving the withdrawal notice, and to take the goods back within 20 days.
e) if the value of the goods decreases for a reason attributable to the BUYER, or return becomes impossible, the BUYER is obliged to compensate the SELLER's losses in proportion to their fault.
f) if, as a result of exercising the right of withdrawal, the order falls below the campaign limit set by the SELLER, the discount benefited from under that campaign is cancelled.
g) the cost of returning the product to the SELLER following withdrawal is covered by the SELLER. When the return is sent with the SELLER's contracted courier (MNG/DHL eCommerce, customer no: 1156010741), no shipping fee is charged to the BUYER.
h) the SELLER does not refund the shipping fee collected from the BUYER at the time of sale.
ARTICLE 5 PRODUCTS TO WHICH THE RIGHT OF WITHDRAWAL DOES NOT APPLY
5.1. Under the Regulation, it is not possible to return goods prepared in line with the BUYER's requests or clearly their personal needs, goods that by their nature are not suitable for return and may raise hygiene concerns such as underwear, and — where the packaging has been opened by the BUYER — any product that has been used beyond trying on, has lost its tag or is no longer resalable.
5.2. In the application of this information and of the contract, the Consumer Arbitration Committees and Consumer Courts at the place where the BUYER purchased the goods or services and where they reside have jurisdiction, up to the value announced by the Ministry of Industry and Trade.
5.3. The BUYER may bring complaints and objections before the consumer arbitration committee or the consumer court at the place where the goods or services were purchased or where they reside, within the monetary limits determined each December by the Ministry of Industry and Trade of the Republic of Türkiye. Information on the monetary limits is published on the Ministry's website.
Please note: before signing the courier's delivery record, please check whether your parcel has been damaged in transit. If your parcel is damaged for any reason, do not sign any delivery document; return the parcel and ask the courier officer to record a report. New products will be sent to you immediately. If products in a damaged parcel are accepted, fouramour.com is not responsible for damage to or missing items inside.
